Terms of service

1. General
These terms govern the provision of services by Musito Adam Muszalik, ul. Powstańców Śląskich 96, 44-177 Paniówki, Poland, VAT ID (NIP) 6431657937 (the Provider).

2. Definitions
Client — a business operating a hair salon, beauty studio or similar service business, using the Provider's services.
Service — musito studio, software provided on a subscription basis, together with rollout, training and support.
Rollout — configuring the Service around how the Client works, migrating data and training the team, carried out at the Client's premises.
3. Scope of services
The Provider supplies: access to the musito studio software, its rollout at the Client's premises, training of the Client's team, technical support, and IT consulting.
The software is delivered through a web browser at an address assigned to the Client. No installation on the Client's side is required.
4. Formation of the contract
The contract is concluded after a conversation and agreement on the scope of the rollout, in documentary form — confirmation of the terms by email is sufficient.
A data processing agreement pursuant to Art. 28 GDPR is concluded together with the service contract.
5. Technical requirements
Using the Service requires a device with internet access and a current web browser, and an active email address.
SMS reminders are billed separately, in line with the agreed price list.
6. Fees
The subscription fee, rollout cost and support rates are agreed individually before the contract is concluded and confirmed in writing or by email.
Payment is made against an invoice, by the date stated on it.
7. Client obligations
The Client undertakes to use the Service lawfully, not to share login credentials with unauthorised persons, and to report any suspected security breach to the Provider.
The Client is the controller of its clients' personal data and is responsible for the legal basis of that processing and for meeting the information obligation towards them.
8. Availability and support
The Provider makes every effort to keep the Service continuously available. Planned maintenance is announced in advance and carried out outside salon opening hours where possible.
Support is provided by email and telephone on business days. Where an issue cannot be resolved remotely, the Provider arranges a visit to the Client's premises.
9. Complaints
Complaints may be submitted by email to adam@musito.pl and should describe the problem and include contact details.
The Provider responds to a complaint within 14 days of receiving it.
10. Termination
The contract is concluded for an indefinite period and may be terminated by either party on one month's notice, effective at the end of the billing period.
After termination the Client may request an export of its data in a commonly used format. Data is deleted in line with the data deletion page.
11. Liability
The Provider is liable for non-performance or improper performance of the contract under the general rules of the Polish Civil Code, excluding liability for lost profits.
The Provider is not liable for the consequences of incorrect data entered by the Client, nor for outages caused by infrastructure providers or telecommunications operators.
12. Changes to these terms
The Client is informed of changes by email at least 14 days in advance. Not terminating the contract within that period constitutes acceptance of the changes.
13. Governing law
Matters not covered by these terms are governed by Polish law. Disputes are resolved by the court with jurisdiction over the Provider's registered address.
